North Dakota's lottery started with a vote rather than a bill: in November 2002, voters approved a constitutional amendment specifically authorizing the state to join multi-state lottery games — and only multi-state games. The North Dakota Lottery opened on June 5, 2004, the 39th state to run one.
That "multi-state games only" restriction still defines the lottery today. North Dakota is legally barred from offering its own in-state draw games or scratch-off instant tickets — every game sold here runs through the Multi-State Lottery Association. Only North Dakota and Wyoming operate this way; every other state supplements the national games with in-state products.
